Legal Concerns Over the Prosecution of a Minor with Disabilities
A prominent lawyer and activist, Abdelhaq Benqadi, has raised significant concerns regarding the prosecution of a minor with mental and physical disabilities who is currently detained in Oujda. The young individual is being held at the local Oujda prison in connection with the Generation Z protests. Benqadi, who is part of the Oujda Bar Association, shared details about the case on his Facebook account, highlighting the severity of the charges against the minor.
The child is accused of several serious offenses, including:
- Using violence against public officials during the execution of their duties, which led to injury or illness
- Insulting public officials while they are on duty
- Vandalizing property belonging to the public prosecutor’s office
- Causing damage to movable property owned by others
In addition to these charges, the minor is also accused of:
- Possessing a weapon without a legitimate reason, in circumstances that could jeopardize public safety
- Inciting more than two people to disobey authority
- Promoting the commission of misdemeanors and felonies with subsequent consequences
- Participating in organizing an unauthorized demonstration while armed with weapons and dangerous tools against public security, and bearing visible arms
- Refusing to disperse from the demonstration site and taking part in an armed gathering at night
Benqadi confirmed that a social investigation conducted by the permanent delegate for protected freedom at the regional directorate for youth affairs concluded that the detained minor “indeed suffers from mental and physical disabilities, lacks control over his hands, and experiences muscular tremors.”
This revelation has sparked widespread concern among legal experts and human rights advocates. Many argue that the prosecution of a minor with such severe disabilities raises serious ethical and legal questions. The case highlights the potential for misuse of the legal system, particularly when it comes to vulnerable individuals.
The situation also brings into focus the broader issue of how minors, especially those with disabilities, are treated within the justice system. There are growing calls for a more compassionate and equitable approach, ensuring that the rights and well-being of such individuals are prioritized.
Implications for the Justice System
The case of the minor with disabilities underscores the need for a thorough review of how the justice system handles cases involving vulnerable populations. It raises important questions about the fairness of the legal process and the adequacy of support systems in place for individuals with special needs.
Legal experts suggest that the prosecution of this minor may not only be unjust but could also set a dangerous precedent. If a person with disabilities is treated as a criminal rather than someone in need of assistance, it could lead to a systemic failure in protecting the rights of all individuals, regardless of their condition.
Moreover, the charges brought against the minor appear to be disproportionately severe for someone who may not fully understand the consequences of their actions. This discrepancy between the nature of the charges and the individual’s capacity to comprehend them further complicates the legal proceedings.
Calls for Reform
In light of these concerns, there are increasing demands for reform within the legal framework. Advocates are urging authorities to consider the unique circumstances of individuals with disabilities and ensure that their rights are upheld throughout the judicial process.
The case has also prompted discussions about the role of social services in supporting individuals with disabilities, particularly in situations where they may become involved with the legal system. There is a growing consensus that a more holistic approach is needed—one that combines legal accountability with appropriate care and support.
As the legal proceedings continue, the outcome of this case could have far-reaching implications for how the justice system treats vulnerable individuals in the future. It serves as a reminder of the importance of fairness, compassion, and understanding in the pursuit of justice.
