A Life Upended by Identity Fraud

Lilian Wanjiru Kingori, a Kenyan woman whose life has been drastically affected by identity fraud, is now facing the consequences of a crime she did not commit. Her story highlights the challenges of cross-border fraud and the inefficiencies within the justice system.

The Unraveling of Lilian’s Life

Lilian, once a promising student and entrepreneur, had been working between Kenya and China. However, her life took an unexpected turn when her identity was used in a fraudulent scheme targeting a Chinese national. This led to her accounts being frozen and travel bans, despite her being a victim of the scam.

The fraud involved a Kenyan man who used Lilian’s personal details to deceive a Chinese individual out of thousands in cryptocurrency. This incident not only disrupted her life but also exposed significant gaps in Kenya’s justice system, leaving innocent victims like Lilian in limbo.

How Did It All Start?

For months, Lilian’s life in China revolved around studying and helping fellow Kenyan students exchange currency between shillings and yuan. This simple arrangement changed when her identity was hijacked, leading to her accounts being frozen and her name becoming entangled in a cross-border scam.

On November 10, 2022, a message appeared on her WeChat from a Chinese national she had never met. The man added her as a friend, and she accepted. He sent screenshots showing he had sent her 16,500 yuan, claiming she hadn’t delivered USDT. Lilian didn’t even know what USDT meant.

The man insisted she had received the money but failed to deliver the digital currency. When Lilian checked, she found that the transactions were real and indeed money had landed in her WeChat and Alipay accounts. However, she had not initiated any of them.

Instead, it was a Kenyan man she knew only as Tyrel, who had used her details in his dealings with the Chinese buyer.

Steps Taken to Clear Her Name

Desperate, Lilian reached out to friends fluent in Mandarin to help her recover her accounts. They managed to unlock her Alipay, but the WeChat remained disabled. Soon after, the same Chinese complainant sent her a friend request on Alipay, claiming her accounts were blocked because of an “unfinished business” with someone called Korkoren, who turned out to be Tyrel.

When she confronted Tyrel, he denied wrongdoing and accused the Chinese man of owing him money. Alarmed, Lilian reported the case at Eastleigh North Police Station on October 29, 2022, and she was referred to the Directorate of Criminal Investigations (DCI) Headquarters on Kiambu Road, where it was logged under OB No. DCI/C/GEN/COMP/6/11/2022.

She cooperated fully, submitting her phone, bank statements, and digital interactions with the said individuals. Her phone was later sent to the DCI Cyber Forensic Lab for data extraction in June 2023, but nothing happened for months, forcing her to pressure the agency.

What Does Lilian Want?

According to Lilian, the suspect was eventually questioned and refunded part of the stolen money. Yet, despite the partial refund, she was never formally cleared, and her digital footprint remains flagged in both Kenya and China.

“I can’t travel. I can’t trade. Every visa check raises red flags. My name is tainted, as if I’m the criminal,” she lamented.

Documents seen by foot-care.co.ke confirm that Lilian’s identity was used in the fraudulent transaction. Communication between the parties also shows that Tyrel acknowledged his involvement and refunded part of the money to the Chinese national.

Despite the evidence, no formal clearance has been issued in her favor, with the DCI not communicating any progress. “Him refunding money means he has accepted he defrauded the Chinese but now wants to fix me because it was not my money. He has acknowledged the mistake to me in text, but it is not written. A report was written to the police that he acknowledged the mistake is what will save me. And need to accept the money he sends so that he can send it directly to the Chinese so that my name can be cleared and my restrictions lifted,” Lilian lamented.
