KFTC Issues Corrective Order to Fine Construction for Subcontracting Fee Violations
The Korea Fair Trade Commission (KFTC) has taken action against Fine Construction for failing to fulfill its obligations under the Fair Transactions in Subcontracting Act. However, the company failed to pay 139.61 million won out of the total subcontracting fee of 2.009 billion won.
Additionally, Fine Construction paid part of the subcontracting fee more than 60 days after receiving the subject matter. During this period, the company did not pay 1.15 million won in delayed interest for the excess time.
This behavior violates Article 13 of the Fair Transactions in Subcontracting Act. According to the law, the principal contractor is required to pay the subcontracting fee by the set payment deadline. This deadline should be as short as possible within 60 days from the date of receiving the subject matter. Furthermore, the principal contractor must also pay delayed interest for any period exceeding 60 days.
In response, the KFTC ordered Fine Construction to pay the unpaid subcontracting fee of 139.61 million won, along with the delayed interest on that amount. Additionally, the company was required to pay the unpaid delayed interest of 1.15 million won.
A representative from the KFTC emphasized the importance of this measure, stating, “This measure is significant in that it clarifies that the principal contractor cannot withhold or exempt payment of subcontracting fees for reasons such as worsening financial conditions.”
