Kebbi Court Bars Three from Claiming ADC Leadership Roles

Legal Dispute Over Leadership of African Democratic Congress in Kebbi State

The Kebbi State High Court, presided over by Justice Sabin Shuaibu, has issued a restraining order against three individuals who are accused of falsely representing themselves as key leaders of the African Democratic Congress (ADC) in the state. The court’s decision aims to prevent Alhaji Sofiyanu Bala Junaidu, Alhaji Muhammad Modi, and Hauwa Muhammad from continuing to act as Chairman, Deputy Chairman, and Secretary of the party.

At a press conference held in Birnin-Kebbi, the acting Publicity Secretary of the ADC, Muhammad Jemilu, addressed selected journalists on behalf of the acting State Chairman, Alhaji Abdulrasak Abubakar. Jemilu explained that the party had taken legal action to stop the three individuals from further claiming leadership roles within the ADC.

He stated that the acting Chairman, along with his interim Executive Council (Excos), approached the court to challenge the legitimacy of the three individuals’ claims to leadership positions. According to Jemilu, the court’s intervention was necessary to ensure that the party’s affairs are managed by the rightful leaders.

“With this development, the State High Court has now stopped the three individuals from parading themselves and holding meetings as representatives of the ADC,” Jemilu said.

Jemilu added that the court had also ordered the three individuals, along with their fellow Excos and agents, to cease any further actions that could be interpreted as representing the ADC. This order is in place until the next hearing and the determination of a motion before the High Court.

Key Details of the Restraining Order

  • Parties Involved: Alhaji Sofiyanu Bala Junaidu, Alhaji Muhammad Modi, and Hauwa Muhammad.
  • Roles Alleged: Chairman, Deputy Chairman, and Secretary of the ADC in Kebbi State.
  • Court Action: A restraining order was issued to prevent them from acting as leaders of the party.
  • Next Steps: The matter will be revisited at the next hearing, where further decisions may be made.

Implications for the ADC in Kebbi State

The legal dispute has raised concerns about the internal dynamics of the ADC in Kebbi State. The party appears to be facing a leadership crisis, with conflicting claims over who holds legitimate authority. The court’s decision is seen as a critical step in resolving these disputes and ensuring that the party operates under proper leadership.

Jemilu emphasized that the acting leadership of the ADC is committed to upholding the party’s values and ensuring transparency in its operations. He also highlighted the importance of legal processes in resolving such conflicts.

What Comes Next?

The next hearing before the High Court will determine the final outcome of the case. Until then, the three individuals named in the restraining order are prohibited from engaging in any activities that could be interpreted as representing the ADC.

This situation underscores the need for clear communication and adherence to legal procedures within political parties. It also highlights the role of the judiciary in maintaining order and resolving disputes in democratic institutions.
