For B (63), a caregiver who was charged alongside A with violating the Elderly Welfare Act, the court also imposed a suspended prison term of one year. Meanwhile, C (39), the facility director charged with destroying evidence, received a fine of 5 million Korean won.
Nature of the Alleged Offenses
A, who served as both the nursing home director and a nurse, was charged with performing medical procedures that should have been conducted or supervised by a doctor. These included inserting a nasogastric tube on four occasions between August 2023 and March 2024. Additionally, in March 2024, A was accused of administering psychotropic drugs to patients alongside other medications, which may have posed significant health risks.
B, the caregiver, was found responsible for abusing two patients in their 70s. The abuse included burning their body hair with a kitchen lighter and hitting their backs. According to reports, these incidents occurred over 13 separate instances in May 2024.
C, the facility director, faced charges related to the destruction of evidence. When investigators from the Namdong District Office and a senior protection agency arrived to investigate the allegations, C was found to have altered the CCTV footage storage period from 60 days to 30 days. This change resulted in the deletion of critical abuse footage.
Judicial Considerations
Judge Hong provided explanations for the sentencing decisions. Regarding A, the judge noted that it was a first-time offense and that all agreements had been reached with the victims’ guardians. For B, the court considered that aside from a previous fine of 20,000 won for violating the Road Traffic Act, there were no other prior convictions. As for C, the judge highlighted that it was also a first-time offense, among other factors.
