Prosecutors Probe Attorney Kim for Defamation Allegations

The Seoul Western District Prosecutors’ Office has initiated an investigation into Attorney Kim Kyu-hyun, who is accused of defamation through false accusations. The legal proceedings come after Attorney Kim raised concerns via YouTube and other online platforms about Seoul Mapo Police Station Chief Kim Wan-ki, a superintendent general, allegedly making remarks that were sympathetic to insurrection during the December 3 emergency martial law.

According to a complaint submitted by Chief Kim on the 10th, it was stated that the claims made by Attorney Kim Kyu-hyun lacked any factual basis. The police chief mentioned that he had already provided a statement to the prosecutors regarding the matter. However, the continued spread of false information, including the release of his real name and photograph, led to allegations of defamation.

On the 5th, Chief Kim posted a pop-up window titled “Seoul Mapo Police Station Chief’s Position on Allegations Raised by a Specific YouTuber” on the official website of the Mapo Police Station. In this statement, he denied the claim that he had made remarks expressing sympathy with insurrection, calling it entirely untrue. He expressed confidence in his innocence and indicated that he would take decisive legal action against the baseless allegations.

Earlier, Attorney Kim shared his account on his personal YouTube channel titled ‘Justice Kyu-hyun.’ According to him, during the time when police were surrounding the National Assembly during the martial law, he addressed a police commander and said, “If you continue to block citizens from entering the National Assembly in this manner, you are sympathizing with insurrection.” The police commander reportedly responded, “I will sympathize with the insurrection.”

Attorney Kim further claimed that he asked for the commander’s name, affiliation, and position. The commander reportedly replied, “8th Mobile Unit Commander, Superintendent General.” He added that this 8th Mobile Unit Commander, Superintendent General, is currently the head of the Seoul Mapo Police Station.

This incident has sparked significant debate and scrutiny, as it involves allegations of misconduct within the police force and raises questions about the integrity of statements made during times of national crisis. The ongoing investigation by the prosecutors’ office aims to determine whether there is sufficient evidence to support the charges of defamation against Attorney Kim Kyu-hyun.

The case highlights the complex interplay between public figures, law enforcement, and the media, especially in high-profile situations where the truth can be difficult to ascertain. As the investigation progresses, it is likely to draw attention not only from legal experts but also from the general public, who are keenly interested in the outcome of such cases.

In addition to the legal implications, the situation underscores the importance of responsible communication, particularly when dealing with sensitive issues that can impact public perception and trust in institutions. Both parties involved have taken strong stances, emphasizing their positions and intentions to pursue legal remedies if necessary.

As more details emerge, it is expected that the narrative around this incident will evolve, potentially influencing public discourse and shaping future actions by both individuals and organizations involved. The resolution of this case could set a precedent for how similar situations are handled in the future, reinforcing the need for transparency and accountability in all sectors of society.
