Judiciary Initiates Nationwide Mediation Sessions

Uganda’s Judiciary Launches Nationwide Settlement Sessions

The Ugandan Judiciary has initiated a country-wide settlement session, aimed at resolving pending court cases through Alternative Dispute Resolution (ADR) mechanisms. This initiative is set to run throughout November and will be implemented in various courts across the nation.

During an appearance on the Salam TV Judiciary Program hosted by Mariam Businge, Deputy Registrar ADR, HW Nanteza Zulaika, commended Ugandans for their acceptance of mediation as a method for resolving disputes. She outlined the types of cases that will be addressed during the November ADR sessions, which include civil, land, family, and commercial matters, with a particular emphasis on open plea bargain sessions.

Zulaika noted that the ADR registry has successfully resolved over 6,083 cases nationwide since its launch last year. The current initiative seeks to resolve 600 cases in courts such as Mbarara, Kasese, Wakiso, Gulu, Lira, Patong, Arua, Kitgum, and Masaka, among others.

The Judiciary encourages citizens to take advantage of the ADR mechanism, which provides a faster, more cost-effective, and compassionate approach to dispute resolution. Additionally, this initiative helps reduce the backlog of cases within the judicial system. The ADR registry has been instrumental in addressing both new and existing cases, with mediation services available at all levels of the court system, from Grade 1 to High Court Circuits.

This initiative is part of the Judiciary’s broader efforts to improve access to justice and promote peaceful conflict resolution. Salam TV Uganda, the first Islamic television station in the country, is supporting this effort through its “Judiciary Show” program. This show offers a platform for insightful discussions and community engagement on topics related to justice and the law.

The “Judiciary Show” airs every Thursday from 11:00 am to 12:00 pm. The channel can be accessed on various platforms, including StarTimes Channel 293, Azam 348, GoTV 326, and Zuuku 884.

Viewers can also watch the show live on Afromobile and through Salam TV Uganda’s digital platforms, such as TikTok, Instagram, Facebook, X, YouTube, and WhatsApp Channel.

Benefits of ADR in the Ugandan Judicial System

The ADR mechanism offers several advantages to individuals and businesses involved in legal disputes. These benefits include:

  • Speed: ADR processes are generally faster than traditional court proceedings, allowing parties to reach resolutions without prolonged delays.
  • Cost-effectiveness: By avoiding lengthy court procedures, participants can save on legal fees and other associated costs.
  • Confidentiality: Unlike public court hearings, ADR sessions often maintain the privacy of the parties involved.
  • Flexibility: ADR allows for tailored solutions that can accommodate the specific needs of the parties, rather than rigid legal judgments.

These features make ADR an attractive option for resolving conflicts, particularly in a country where the judicial system faces significant backlogs.

Expanding Access to Justice

The implementation of ADR across multiple court levels ensures that citizens have access to dispute resolution mechanisms regardless of their location or the complexity of their case. This inclusivity is crucial for promoting fairness and ensuring that all Ugandans can seek justice without facing unnecessary barriers.

Furthermore, the collaboration between the Judiciary and media outlets like Salam TV Uganda plays a vital role in raising awareness about ADR and encouraging public participation. By providing educational content and facilitating discussions, these initiatives help demystify the legal process and empower individuals to make informed decisions.

Future Outlook

As the November ADR sessions continue, there is optimism that the initiative will not only address existing case backlogs but also set a precedent for future dispute resolution efforts. The success of this program could lead to broader adoption of ADR in other regions and legal contexts, further enhancing the efficiency and effectiveness of the Ugandan judicial system.

With continued support from the media and active participation from the public, the ADR initiative has the potential to transform how disputes are handled in Uganda, making justice more accessible and equitable for all.
