A Woman’s Legal Battle Over Jealousy and Marriage Dissolution

A woman named Bashirat Qodri has taken legal action against her husband, Solihu Musa, seeking a divorce at the Area Court in Centre-igboro, Ilorin, Kwara State. Her reason for the divorce stems from what she describes as her husband’s excessive jealousy.

According to her statement, Bashirat asked the court to dissolve their marriage and grant her custody of their only child. She also requested that her husband be held responsible for the child’s upbringing.

Bashirat explained that her husband asked her to leave his house before the first week of September, after which she packed her belongings and left. She wanted to rent a new place, but the property had a condition: the tenant must be married. To meet this requirement, she persuaded the caretaker to present himself as her husband.

However, her husband soon discovered where she was living and began harassing her, accusing her of adultery. This led to further tension in their already strained relationship.

Solihu, on the other hand, agreed to the divorce, claiming that his wife had moved into another man’s house with their three daughters. He stated that the wife had two female children from a previous marriage and one child with him. He added that she does not take proper care of the children and is not capable of doing so.

The presiding judge, Idris Etsu, delivered the judgment, stating that since both parties were no longer interested in continuing their marriage, there was no need to force them to stay together. As a result, the judge dissolved their marriage and granted the plaintiff (Bashirat) custody of their child.

Etsu also instructed Bashirat to observe a three-month iddah period before remarrying. During this time, she must remain in seclusion, as per Islamic tradition.

In addition to granting custody, the judge ordered the defendant (Solihu) to pay N10,000 monthly as maintenance for the child. He also required Solihu to be responsible for the child’s education and medical care when necessary.

Furthermore, the judge allowed the defendant access to their child at reasonable times, ensuring that the child maintains a relationship with both parents.
